9.1 Any student applying to enrol on a course with FSB reserves a place for himself/ herself. This may, when places are limited, result in a place being denied to another, and may therefore result in a reduction in the numbers FSB is able to recruit and resultant loss of income.
9.2 When applying to a course with FSB, a student enters into a legally binding contract. FSB’s contractual obligation is to provide the training as described in this Policy, subject to the availability of resources and viable student numbers. In circumstances where FSB cannot meet the terms of the contract (other than for reasons outside of its control, or as specified in the enrolment terms and conditions) it will refund the fee paid.
9.2.1 Tuition fees will be refunded in full if the School withdraws or discontinues the course applied for and fails to offer an acceptable alternative course. FSB is not however liable for any consequential loss including but not limited to travel and accommodation costs, and loss of earnings.
9.2.2 Where FSB cancels a course which is a mandatory component of a Group Award (e.g. an Edexcel award) and no alternative is provided by FSB and so the student is prevented from achieving the Group Award, FSB will refund the fees for any and all parts of the Group Award on which the student had already booked and paid the fees at the time FSB cancelled its course.
9.3 FSB’s admissions process is subject to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you have applied through our online enrolment form or have accepted the offer by post or email subsequent to contacting our admissions staff by telephone or email only, your acceptance of these terms will be treated as a ‘distance contract’. In such cases, after accepting an offer you have a right to cancel your acceptance of the offer at any time up to 14 days after you confirm your acceptance. If you cancel within this period you will be entitled to a refund of any deposit/tuition fees which you have paid and you will not be bound by this policy and the course Terms and Conditions. If you have requested early performance of the services e.g. you apply within 2 weeks of an induction day or course start date, then FSB will be entitled to deduct the value of any such services provided at the time of your cancellation request. Refunds requested by students of a ‘distance contract’ will paid within 14 days of the cancellation request. FSB prefers these requests be made on the cancellation form by email or delivery in person to the Administration Office,
9.4 All refunds made after the 14 day cancellation period will be paid less the reservation fees of £250, and any deferral/transfer fees and expenses reasonably incurred on the student’s behalf by FSB.
9.5 In circumstances where a refund of course fees is to be made in respect of a student, unless authorized otherwise, FSB will normally pay the refund directly to the organization or individual who made the payment of the fee to FSB. If a student wishes to authorise someone else to collect the refund on his/her behalf, FSB will require and authorisation letter and a valid ID from the authorised person.
9.6 Refunds will normally be made by cheque made payable to the applicant. If requested and depending on how the original payment was made, the other options for refund are credit or debit card, bank transfer and bankers draft. No refund will be made in cash.
9.7 FSB reserves the right to dismiss any student at any time for behaviour which is deemed to be unprofessional, inappropriate or disruptive to other students/staff. No fees will be refundable for any student dismissed under this section.
